Your ability to participate in Powershop Australia Pty Ltd’s (Powershop) demand response program (Curb Your Power) is subject to your acceptance of the following terms and conditions.
To be eligible to participate in Curb your Power you must:
(a) be a Powershop customer in Victoria;
(b) have a smart meter;
(c) register to Curb Your Power via powershop.com.au/demand-response-curb-your-power/ and agree to the terms and conditions; and
(d) not be or live with someone who is a vulnerable customer (see below).
Once you are registered to participate in Curb Your Power, to be eligible to participate in an Event you must have been a Powershop customer for at least 45 days prior to the Event.
A vulnerable customer is a person who would be adversely affected if they were to reduce their electricity usage. Vulnerable customers may include those on life support, the elderly, disabled or sick.
2. Explanation of Curb Your Power
Curb Your Power is a demand response program designed to reduce demand on the National Electricity Market (NEM). Powershop will be notified by the Australian Energy Market Operator (AEMO) of an upcoming peak demand period. If you participate in Curb Your Power, during a peak demand period you may be asked by Powershop to reduce your energy usage for a certain period of time (up to a maximum of four (4) hours) (Event). There will a maximum of ten (10) Events each year.
You will be rewarded if you meet the Curb Target (find out more about the Curb Target here) during the Event (Event).
By participating in Curb Your Power you acknowledge and agree:
(a) You must not participate in any other demand response program.
(b) Powershop may notify you of an Event up to ten (10) times each year.
(c) An Event may last between one (1) and four (4) hours.
(d) You may be given a minimum of one (1) hour or a maximum of seven (7) days’ notice before an Event.
(e) An Event may occur anytime between 10am to 10pm on Monday to Friday.
(f) If you participate in an Event, Powershop will determine at its absolute discretion whether you have met the Curb Target. Find out more about the Curb Target and how your reduction in usage during an Event is calculated here: powershop.com.au/demand-response-how-to-curb-your-power/.
(g) The reward for meeting your Curb Target may change from time to time and residential and business customers may have different rewards for participation.
(h) You will be notified whether you have met your Curb Target within 7 business days of the relevant Event.
(i) You determine at your absolute discretion whether to participate in an Event and you can opt-out at any time by emailing firstname.lastname@example.org.
3. Provision of Information
By participating in Curb Your Power, you agree to Powershop:
(a) providing your meter data and National Meter Identifier (NMI) to government agencies including but not limited to, the Australian Renewable Energy Agency (ARENA), the Behavioral Economics Team of the Australian Government (BETA) and AEMO.
(b) contacting you via SMS for the purposes of Curb Your Power on the mobile number entered on the Curb Your Power registration form.
4. Disclaimer and Limitation of Liability
(a) By participating in Curb Your Power you acknowledge and agree that you are not, and do not live with, someone who is a vulnerable customer.
(b) In no event shall Powershop be held liable to you for any damage, claim or loss arising directly or indirectly from Curb Your Power or an Event, or in any way in relation to your participation in Curb Your Power or an Event, including, but not limited to, any consequential loss (including by reason of the negligence of a party).
